The AP Govt has issued GO.5 dt:24.02.2014 which is related to Constitution of State Advisory Council to
assist the Government for effective implementation of “Right to Education” in Andhra Pradesh. The advisory
council panel will look after the implementation of A.P. Right of Children to

ABSTRACT
School Education – Right of Children to Free and Compulsory Education Act,
2009, (Central Act No. 35 of 2009) – Constitution of State Advisory Council to
assist the Government for effective implementation of A.P. Right of Children to
Free and Compulsory Education Act, 2009– Orders - issued.
Read the following:-
1. Gazette of India – Extraordinary – Part II – Section I, No. 39, New Delhi,
issued by Ministry of Law & Justice on the Right of Children to Free and
Compulsory Education Act, 2009 – (Central Act No. 35 of 2009, dated:
26th August, 2009.
2. The Andhra Pradesh Right of Children to Free and Compulsory
Education Rules, 2010 issued vide G.O. Ms. No. 20 School Education
(PE-Progs.I) Department, dated 03.03.2011 and notified in Gazette No.
10 dated 05.03.2011.
3. G.O. Ms. No. 130 School Education (PE-Progs.I) Department, dated
09.09.2011 notified in Gazette No. 42 dated 09.09.2011.
4. From the State Project Director, Rajiv Vidya Mission (SSA), A.P.
Hyderabad Lr. No. 8374/RVM(SSA)/RTE CELL/2013, dt: 04.02.2014.
ORDER:
In the reference 1st read above, Government of India enacted Right of
Children to Free and Compulsory Education Act, 2009, which came into force with
effect from 01.04.2010. As per Section 34 of the Right of Children to Free and
Compulsory Education Act, 2009, the State Governments are required to
constitute, by notification, a State Advisory Council consisting of such number of
Members, not exceeding fifteen as the State Government may deem necessary,
to be appointed from amongest persons having knowledge and practical
experience in the field of elementary education and child development. The State
Advisory Council (SAC) shall advise the State Government on implementation of
the provision of the Act in an effective manner.
2. In the reference 2nd read above, the Government of Andhra Pradesh have
framed the A.P. Right of Children to Free and Compulsory Education, Rules, 2010
issued in G.O. Ms. No. 20, School Education(P.E.Prog.I)Department, dated
03.03.2011. The Rule 28 of said Rules, 2010 stipulates composition and functions
of the State Advisory Council.
3. In the reference 4th cited, the State Project Director, Rajiv Vidya Mission
(SSA), A.P. Hyderabad has sent a proposal for nominating the members to the
State Advisory Council.
4. Government after careful examination of the proposal of State Project
Director, Rajiv Vidya Mission (SSA), A.P. Hyderabad, and keeping in view of the
Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010
issued vide G.O. Ms. No. 20 School Education (PE-Progs.I) Department, dated
03.03.2011, hereby constitute State Advisory Council to advise the State
Government on implementation of the provisions of the Right to Education Act,
2009 in an effective manner.

Children to Free and Compulsory Education Rules, 2010 issued in G.O. Ms. No.
20, School Education (PE.Prog.I) Dept dated 03.03.2011 and subsequent
amendment issued in G.O. Ms. No. 130, School Education (PE-Prog.I)
Department, dated 09.09.2011.
6. The Commissioner & Director of School Education, A.P. Hyderabad and
the State Project Director, Rajiv Vidya Mission (SSA), A.P. Hyderabad shall take
further necessary action accordingly.
